These Terms of Service ("Terms") govern your use of PoolSide's app, website, dashboard, and related services.
By creating an account or using PoolSide, you agree to these Terms. If you accept on behalf of a club or organization, you confirm you are authorized to do so.
You must provide accurate account information and keep it reasonably current.
If you are under 18, parent/guardian approval may be required depending on account configuration and applicable law. Accounts may be restricted until required consent is verified.
You are responsible for maintaining account credential security and for activity under your account.
You must promptly notify us of suspected unauthorized access and must not bypass role-based permissions.
PoolSide provides swim training, competition, club operations, analytics, calendar sync, notifications, and AI-assisted workflow tools.
Features may be changed, improved, limited, or removed over time.
You agree not to misuse the service. Prohibited behavior includes:
You retain ownership of data/content you submit.
You grant PoolSide a limited license to host, process, and display submitted data as needed to operate, secure, and improve the service.
You confirm you have the rights and permissions (including guardian approvals where required) to submit personal data to PoolSide.
PoolSide may provide AI-assisted summaries, parsing, and recommendations.
AI outputs may be incomplete or incorrect and are support tools only. You remain responsible for reviewing outputs before relying on them.
PoolSide is not a medical provider and does not provide medical advice.
Some features are paid and may be offered on a recurring subscription basis through Stripe.
Where a trial is offered, paid billing starts automatically after the trial unless canceled beforehand.
By starting a paid plan, you authorize recurring charges under the pricing and billing terms shown at checkout.
You can manage or cancel eligible subscriptions through billing settings/portal or by contacting support.
Fees are generally non-refundable except where required by law.
PoolSide relies on third-party providers and infrastructure, including Supabase, Stripe, Resend, Google Gemini API, and push/calendar providers.
Your use of integrated third-party services may also be subject to those providers' terms and policies.
Our processing of personal data is described in the Privacy Policy.
By using PoolSide, you acknowledge that your data is handled as described in that policy.
PoolSide software, branding, interface design, and service materials are owned by PoolSide or its licensors and are protected by intellectual property laws.
Except for rights expressly granted in these Terms, no rights are transferred to you.
We may suspend or terminate access for material breach of these Terms, legal/security risk, abuse, or unresolved billing issues.
You may stop using PoolSide at any time.
Clauses that by nature should survive termination will survive, including billing obligations, disclaimers, liability limits, indemnity, and dispute terms.
PoolSide is provided "as is" and "as available." To the extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted service or error-free and always-accurate outputs.
To the maximum extent permitted by law, PoolSide and its affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from or related to the service.
Our aggregate liability for claims relating to the service is limited to the amounts paid to PoolSide for the service during the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
To the extent permitted by law, you agree to indemnify and hold PoolSide harmless from claims, losses, liabilities, and expenses arising out of your misuse of the service, your content, or your breach of these Terms.
We may update these Terms from time to time. If we do, we will update the Last updated date and may provide additional notice for material changes.
Unless a separate signed agreement states otherwise, these Terms are governed by the laws applicable where the PoolSide contracting entity is established, excluding conflict-of-law rules.
Disputes will be handled by the courts with jurisdiction over that contracting entity, except where mandatory consumer law gives you additional local rights.
